It's just a question of estimating the labor hours, wages, and court costs for bringing this to trial and appealing to the Supreme Court.
I take it back, the plaintiffs could not ever win this lawsuit in the Supreme Court. The Supreme Court is a jury that is not comprised of morons, and the DOJ could definitely win on appeal to the Supreme Court. The Supreme Court would not hold the government responsible for this.
