  1. In jurisprudence, procedural defenses are forms of defense challenging the legitimacy of the legal proceeding. A party argues that it should not be held liable for a legal charge or claim brought against them by some legal process, because it has been found such a process is illegitimate. Procedural defenses are built into legal systems as incentives for systems to follow their own rules. In common law jurisdictions the term has applications in both criminal law and civil law. Procedural defenses do not settle questions of guilt or innocence in a criminal proceeding, and are independent of substantive findings for or against a plaintiff or defendant in a civil proceeding. As examples: Defendants might claim there is something about the method of bringing them to be judged, that is unable to result in justice done to someone in their situation. They might claim the process is incompatible with the goals of the justice system.

In the United States, procedural defenses include:

    collateral estoppel

    denial of a speedy trial

    double jeopardy

    entrapment

    prosecutorial misconduct

    selective prosecution

    exclusionary rule

facts found by judge rather than jury

denial or neglect of public counsel appointment

no opportunity to impugn witnesses against you

breaches of due process, such as precedent established in Rhode Island v. Innis (1980) or Miranda v. Arizona (1966)

denial of a jury trial in a civil case

Traditional procedural defenses in "equity" in the U.S. and other common law jurisdictions:

    laches

    estoppel

    Wikipedia selective Justice

  2. Does anyone think that the DAs in these cases are charging too high & that's why alot of these people are not being indicted? I agree with judge in this case. But they blame the judges not these left wing attorneys who are trying to make a name for theirselves by charging with ridiculous charges.

  3. Wait a minute, WHERE are ALL these BS stories about Breonna coming from exactly? She was murdered and murderers ARE supposed to go to PRISON!!!

  4. This is easily resolved with reviewing one of three body cam footage of the officers. Unless they collaborated to turn them off for an illegal entry..

  5. I am so sick of hearing about black civil rights. OMFG. Its so fcking old. Every country they live in black people complain about their rights.

  6. ABC is baiting with the title…..it should read, "Only one officer charged……" Some people only read the headlines and ABC is fully aware of what they are doing….ALL of the media is doing this to keep everyone at each others throats. The people writing these info pieces should be charged with inciting violence. Don't get me wrong. I'm not saying the charge is good or bad etc….all I am saying is the headline(s) that every media outlet does this and it's not right.

  7. Breanna Taylor is a perfect example on how poor choice in men can cost women their lives. Stay away from drug dealers and trigger happy thugs!

  8. Research who Breonna Taylor really is! And fyi… When you open fire on an armed Policeman they will shoot you! 🇺🇸

  9. There's a Trump supporter in the comments who's claiming i was delusional for quoting the declaration of Independence then after I informed him that's what it's from he started claiming I wrote the decoration of independence 🤣🤣🤣 here's the quote "we not only have the right but we also have the duty to alter or abolish any government that does not secure our unalienable rights, including life, liberty, and the pursuit of happiness."
